Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Vioworks ("Vioworks", "we", "us", or "our"), operated by Emre Topdemir, located at Zühtüpaşa Mahallesi, Hasan Amir Sokak 15/1C, Kadıköy, İstanbul, Türkiye (İstanbul, Türkiye). They govern your access to and use of the website at vio.works and all related services.

By creating an account, uploading content, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the platform.

• Service(s) — the Vioworks platform, including vioSend, vioFind, and vioSelect.
• User — any person who accesses the platform, whether a registered account holder, a recipient, an event attendee, or a selection client.
• Account Holder — a registered user, typically a photographer or studio, who uploads and manages content.
• Content — any photos, files, metadata, names, notes, or other material uploaded to or generated within the Service.

• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• You are responsible for providing accurate registration information and for keeping it up to date.
• You are responsible for safeguarding your password and for all activity under your account.
• You must notify us immediately at hello@vio.works of any unauthorized use of your account.

You retain all ownership rights in the Content you upload. We do not claim ownership of your photos or files.

You grant Vioworks a limited, worldwide, royalty-free license to host, store, process, transmit, resize, and display your Content solely to operate and provide the Services to you and your intended recipients. This license ends when the Content is deleted, except to the extent it has already been shared with recipients or where retention is required by law.

We will never use your Content for advertising or to train artificial intelligence models.

You represent and warrant that you have all necessary rights and consents for the Content you upload. You agree not to use the Services to:

• Upload, transfer, or share content that is illegal, infringing, defamatory, or that violates the privacy or intellectual property rights of others
• Process biometric data without obtaining all consents required by applicable law
• Upload malware, viruses, or any code designed to disrupt or damage the platform
• Attempt to gain unauthorized access to the platform, other accounts, or our systems
• Use the Services to send spam or unsolicited communications
• Resell, sublicense, or commercially exploit the Services without our written permission
• Upload content involving minors that is unlawful or harmful

Some features are offered on a paid or subscription basis. Pricing, billing cycles, and plan limits are described at the point of purchase.

• Fees are charged in advance and, unless required by law, are non-refundable.
• Subscriptions renew automatically unless cancelled before the renewal date.
• We may change pricing with reasonable prior notice; changes apply from your next billing cycle.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.

Transfers, galleries, and events are subject to storage limits and expiry periods that depend on your plan. When a transfer expires, an event is deleted, or a selection access period ends, the associated Content and any facial embeddings are deleted and cannot be recovered. You are responsible for downloading or backing up Content before it expires.

The Services, including the Vioworks name, logo, software, design, and all related intellectual property, are owned by Emre Topdemir and protected by applicable law. Except for the rights expressly granted to you, no rights are transferred. You may not copy, modify, reverse-engineer, or create derivative works of the platform.

The Services rely on third-party infrastructure including Amazon Web Services, Supabase, Resend, and Vercel. Your use of the Services is also subject to those providers' applicable terms. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.

We aim to keep the Services available and reliable, but we provide them on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure access, and we may suspend the Services for maintenance, updates, or circumstances beyond our control.

To the maximum extent permitted by law, the Services are provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of facial recognition matches, or non-infringement. Facial recognition is probabilistic and may produce incorrect or incomplete matches.

To the maximum extent permitted by law, Vioworks and Emre Topdemir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the Services.

Our total aggregate liability for any claim relating to the Services shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Vioworks, Emre Topdemir, and its officers and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Content, your use of the Services, or your violation of these Terms or applicable law.

You may stop using the Services and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, misuse the Services, or where required by law. Upon termination, your right to use the Services ends and your Content may be deleted, subject to our data retention obligations.

We may update these Terms from time to time. Material changes will be notified to registered users by email and reflected by the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of İstanbul, Türkiye, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts and enforcement offices of İstanbul, Türkiye, unless mandatory consumer-protection law provides otherwise.
